These Terms of Service (“Terms”) govern your access to and use of 3A Dine (“3A Dine”, “we”, “us”, or “our”), including our website, restaurant management platform, digital menu tools, ordering tools, dine-in tools, table reservation tools, payment gateway setup tools, and related services (the “Service”).
By creating an account, accessing the Service, or using the Service on behalf of a restaurant or business, you agree to these Terms.
3A Dine is currently intended for use by restaurants, restaurant owners, restaurant staff, and restaurant customers in the United Kingdom.

1. Who we are
3A Dine provides software tools for restaurants and food businesses, including digital menus, restaurant setup, branch management, ordering workflows, dine-in workflows, table reservations, checkout profiles, business and invoice profile tools, and payment gateway setup.
3A Dine is a software platform. We are not a restaurant, food business operator, payment institution, bank, delivery provider, or tax adviser.
2. Eligibility and account
- You must be at least 18 years old to create a restaurant owner or admin account.
- You must be legally able to enter into a binding contract.
- If you use the Service on behalf of a restaurant, company, sole trader, partnership, or other organisation, you confirm that you are authorised to do so.
- You must provide accurate, complete, and up-to-date information.
- You are responsible for safeguarding your login credentials and account access.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly if you believe your account has been accessed without authorisation.
3. Restaurant owner verification
We may require restaurant owners or account administrators to verify their phone number using a one-time SMS code or similar verification method.
Phone verification is used to help protect accounts, reduce misuse, and confirm that a real contact method is associated with the restaurant owner account.
You must not share one-time codes with anyone, including restaurant staff or 3A Dine support.
4. Free trial and subscriptions
We may offer a free trial, including a 15-day free trial, subject to the terms shown during signup, checkout, or in your account settings.
Trial availability, duration, features, and limits may change from time to time.
Paid plans, pricing, taxes, billing cycles, renewal terms, and subscription features will be shown at checkout, in your admin settings, or in other billing information provided to you.
If you fail to pay applicable fees, we may suspend, restrict, or terminate access to paid features or the Service.
Unless stated otherwise, fees are non-refundable except where required by law or expressly agreed by us.
5. Restaurant setup and business information
You are responsible for ensuring that all restaurant, branch, menu, business, invoice, branding, contact, tax, and payment setup information you provide is accurate, lawful, and kept up to date.
Business and invoice profile details may be used on receipts, invoices, branch documents, customer-facing documents, and restaurant records. You are responsible for ensuring that these details are correct and that you are authorised to use them.
Customer-facing details, such as restaurant logo, website, tagline, social links, support email address, and support phone number, may appear on restaurant pages, menus, receipts, reservation pages, or ordering pages.
6. Restaurant content and responsibility
You are responsible for all content, information, images, menu data, prices, descriptions, availability, settings, branding, contact details, and other material you upload, enter, publish, or manage through the Service (“Restaurant Content”).
You confirm that you have all rights, permissions, and licences needed to use and publish your Restaurant Content through the Service.
You must not upload or publish content that is unlawful, misleading, infringing, abusive, defamatory, fraudulent, harmful, or otherwise inappropriate.
We do not guarantee the accuracy, completeness, legality, availability, or suitability of Restaurant Content.
7. Food, allergens, dietary information, and consumer obligations
Restaurants are responsible for complying with all laws and regulations that apply to their food business, including food safety, allergen information, labelling, pricing, consumer protection, trading standards, VAT, tax, and advertising requirements.
You are responsible for ensuring that menu descriptions, allergen information, dietary labels, ingredient information, prices, availability, and special instructions are accurate and kept up to date.
3A Dine does not verify food safety, ingredients, allergens, nutritional content, menu accuracy, food preparation, food delivery, or order fulfilment.
If customers provide special requests, allergy information, dietary requirements, accessibility requests, or seating preferences, the restaurant is responsible for reviewing and handling that information appropriately.
8. Orders, dine-in, and table reservations
The Service may allow restaurants to receive or manage customer orders, dine-in workflows, collection orders, delivery orders, table reservations, and related customer communications.
Restaurants are responsible for accepting, rejecting, preparing, fulfilling, cancelling, refunding, and managing orders and reservations.
3A Dine is not responsible for food preparation, food quality, order fulfilment, table availability, customer attendance, delivery, delays, cancellations, refunds, complaints, or disputes between restaurants and customers.
Customers should contact the relevant restaurant directly for questions about orders, bookings, food, allergens, refunds, service issues, or complaints.
9. Payments
The Service may support in-store payment options, such as cash or card/POS terminal, and online payment options through the supported gateway for the restaurant's country where enabled.
For in-store payment methods such as cash or card/POS terminal, payment is handled directly by the restaurant outside 3A Dine.
Where a restaurant connects its own Stripe or Razorpay account, online payments are processed by that gateway. The provider's own terms, policies, and requirements apply.
Full customer card details, restaurant bank account details, bank proof, identity documents, incorporation documents, and gateway KYC documents are collected and processed by Stripe or Razorpay where required.
3A Dine does not process, hold, or settle customer funds directly. The restaurant is responsible for its own gateway account and for payment, refund, tax, chargeback, customer-service, and compliance obligations that apply to its business.
3A Dine does not support or store manual bank transfer details.
10. Acceptable use
You agree not to:
- use the Service for unlawful, harmful, fraudulent, abusive, or misleading activities;
- attempt to bypass security, authentication, access controls, usage limits, or rate limits;
- access, copy, modify, or use data that does not belong to you;
- interfere with or disrupt the Service or related systems;
- upload malware, malicious code, or harmful content;
- reverse engineer, scrape, copy, or reproduce the Service except as permitted by law;
- use the Service to infringe intellectual property, privacy, or other rights;
- misrepresent your identity, business, restaurant, products, services, or authorisation;
- use the Service in a way that could damage 3A Dine, restaurants, customers, or third parties.
11. Data, privacy, and security
Our processing of personal data is described in our Privacy Policy.
You agree to comply with applicable data protection laws for any personal data you collect, upload, access, or process through the Service.
Where you use 3A Dine to process customer data, order data, reservation data, staff data, or special request information, you are responsible for ensuring that you have a lawful basis to process that data and that you provide any privacy information required by law.
You must not use the Service to collect unnecessary, excessive, unlawful, or inappropriate personal data.
12. Service availability and changes
We aim to provide a reliable Service, but we do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.
We may modify, improve, suspend, restrict, or discontinue any part of the Service at any time.
We may perform maintenance, updates, security work, or technical changes that affect access to the Service.
13. Third-party services
The Service may integrate with or depend on third-party services, including Firebase, Google Cloud, Vercel, Stripe, Razorpay, email providers, SMS verification providers, analytics providers, or other service providers.
Third-party services may be subject to their own terms, privacy policies, availability, limits, and requirements.
We are not responsible for failures, outages, changes, fees, restrictions, or acts or omissions of third-party providers.
14. Intellectual property
The Service, software, design, features, platform, database structure, workflows, branding, and related intellectual property are owned by 3A Dine or its licensors.
You must not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as permitted by law or with our written permission.
You retain ownership of your Restaurant Content. You grant us a limited, worldwide, non-exclusive licence to host, store, process, display, reproduce, and use your Restaurant Content only as needed to provide, operate, secure, support, and improve the Service.
15. Feedback
If you provide suggestions, ideas, comments, feedback, or improvement requests, you allow us to use them without restriction or compensation, provided we do not use your confidential information or personal data except as described in our Privacy Policy.
16. Suspension and termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate your access to the Service if:
- you breach these Terms;
- you fail to pay applicable fees;
- your use creates security, legal, operational, or reputational risk;
- we are required to do so by law, regulation, court order, or third-party provider requirement;
- we reasonably believe your account is being misused or accessed without authorisation.
After termination, we may retain certain information as described in our Privacy Policy or as required for legal, accounting, security, fraud prevention, dispute handling, or compliance purposes.
17. Disclaimers
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, we disclaim all warranties, conditions, and representations, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
We do not warrant that the Service will meet your requirements, increase sales, prevent errors, prevent disputes, ensure legal compliance, or operate without interruption.
18. Limitation of liability
Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
To the maximum extent permitted by law, 3A Dine will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, opportunity, or anticipated savings.
To the maximum extent permitted by law, our total liability arising out of or relating to the Service or these Terms will not exceed the amount you paid to 3A Dine for the Service in the three months before the event giving rise to the claim, or £100 if no amount was paid.
19. Indemnity
You agree to indemnify and hold harmless 3A Dine from claims, losses, liabilities, damages, costs, and expenses arising from:
- your breach of these Terms;
- your Restaurant Content;
- your restaurant operations, food, orders, reservations, refunds, or customer disputes;
- your breach of food safety, allergen, consumer, tax, employment, or data protection laws;
- your misuse of the Service;
- your use of Stripe, Razorpay, or other third-party services.
20. Governing law and disputes
These Terms are governed by the laws of England and Wales.
The courts of England and Wales will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service, except where applicable law gives you mandatory rights to bring claims elsewhere.
21. Changes to these Terms
We may update these Terms from time to time.
When we update them, we will change the “Last updated” date above. If changes are material, we may take reasonable steps to notify you, such as by email, dashboard notice, or in-app message.
Continued use of the Service after updated Terms take effect means you accept the updated Terms.
